Application For a Variation

There are a number of options available once judgment has been made to vary the order, this depends on the circumstances.

If the order was made by a district judge or if more than 14 days have passed since it arrived, then you may apply to vary the order by using the court form 'Application to vary an order N245'.

The fee for this can be waived in cases of hardship by using form EX160.

If the order was made by a court official and not a district judge then you should write to the court within 14 days to explain the situation and request a ‘Re-determination’.

There is no fee for this.

If you are in a position to offer no payment at all then you can apply to have the judgment set aside this is done by means of a ‘N244 Application Notice’ supported by a financial statement. A fee is normally payable, which may be waived in cases of hardship. The case will be transferred to your local court and then a date for a hearing set.

The forms N245- N244 and EX160 are available from any county court.
