Before a court will consider an application for a charging order, the lender must have issued a county court judgement and you must have failed to make payments on that judgement, even if only one instalment under a judgement has been missed the creditor can apply for a charging order, unless subsequently the client has applied for a variation, actually obtained an instalment order and maintained the payments. The effect of a charging order is to turn an unsecured debt into a secured one.
